Goldwater Responds...



Not favorably, I'm afraid. Here's their response to Matt Hulsizer's announcement last night. Here's a copy of his letter to them.
And the response today from the Goldwater website:

March 21, 2011Phoenix — Late Friday afternoon, potential buyer of the Phoenix Coyotes Matthew Hulsizer delivered a letter to the Goldwater Institute stating, “Arizona Hockey is willing to modify the lease agreement with Glendale to guaranty [sic] to the city that they [sic] will receive direct revenues from the Coyotes, Arena and parking that have a value to day [sic] of at least $75 million. If the cumulative direct revenues received from the Coyotes, Arena and parking are that amount, than [sic] the shortfall will be the liability of Arizona Hockey Holdings.” No further details were presented. 
“The offer recognizes the significant risk to taxpayers under the current deal and to that extent is a positive development,” said Goldwater Institute president Darcy Olsen. “Regrettably, however, the proposal fails to remedy the core legal violation at issue, leaving the expensive taxpayer gamble intact.” 
The Arizona Republic reports that the bonds offered by the city of Glendale for Mr. Hulsizer will ultimately cost taxpayers $250-340 million. That figure includes the initial bond offering of $100 million the city plans to issue to help Mr. Hulsizer buy the team, as well as projected interest on that bond. Additionally the city is obligated to pay Mr. Hulsizer $97 million for arena management over 5 years. 
Mr. Hulsizer apparently is promising only that revenues from all sources—such as arena events, rental payments, parking revenues—will total at least $75 million over 30 years and that he would make up any shortfall up to that amount. That would still leave taxpayers on the hook for as much as $362 million, which Mr. Hulsizer is not guaranteeing.  
Glendale taxpayers have been given no protection against a future team bankruptcy. If the team goes bankrupt again, taxpayers will assume the full cost of bond repayment—this is on top of what taxpayers are already paying for the construction of Jobing.com Arena. Any restructured deal should legally protect taxpayers from liability for the bond repayment if the team fails again.  
Arizona’s Constitution categorically prohibits the use of public debt to finance private businesses. Glendale justifies public borrowing on the grounds that the city is acquiring valuable consideration in the form of parking rights. However, the city may already own a significant portion of those rights, and the team does not presently have the legal right to sell the rest. If so, the city essentially is “selling” parking revenue rights to itself, which would be a clear violation of the Gift Clause. The new proposal does not address this. 
“We hope Glendale will put a deal on the table that doesn’t expose taxpayers to unnecessary risk,” said Darcy Olsen, president of the Goldwater Institute. In an email to the Institute, Mr. Hulsizer wrote, “I don’t need the City’s credit to buy the team.” The Goldwater Institute has recommended that Mr. Hulsizer use his resources to buy the team and hold taxpayers harmless. In a less than perfect compromise, Mr. Hulsizer could also protect taxpayers by personally guaranteeing the full repayment amount of the bonds. 
Mr. Hulsizer also says he is relieving Glendale of its obligation to pay the National Hockey League $25 million for team losses over the last year. It is not clear whether Mr. Hulsizer would actually repay the obligation, or whether the NHL would be forgiving the debt, thus costing Mr. Hulsizer nothing.
The City of Glendale continues to ignore multiple requests from the Goldwater Institute to disclose public information related to the funding source of the $25 million and the documentation supporting the proposed arena management fees.

Hulsizer Brings Out The Big Guns...

During last night's game against the Blackhawks at Jobing.com Arena, Phoenix Coyotes suitor Matthew Hulsizer appeared on the Fox Sports Arizona broadcast with some big news:

To back him up - he brought out the big guns:


Senator John McCain and Former Attorney General Grant Woods back up Matthew Hulsizer's bid.


Probably the biggest thing about this was John McCain's words backing up Hulsizer's new amendments to his bid. Why? He's Goldwater's "Golden Boy" so to speak. Pressure from a United States Senator to back off and let this deal move forward is bound to leave quite the impression upon the big boys at Goldwater.

Arizona's United States Senator John McCain was interviewed by Todd Walsh during tonight's Coyotes/Blackhawks game about the Coyotes ownership issues and here is what he said:

"I have been encouraging people to sit down and negotiate and make people understand how important the Coyotes are – not just to Glendale, but to the entire state of Arizona. We are a big league Valley and the economic impact right now would be very devastating to the state of Arizona."

On tonight's news about Matthew Hulsizer concession on the parking issue: "I hope that now the Goldwater Institute’s concerns will be satisfied and they will now sit down and negotiate and make sure that we can have an assured presence of the Coyotes for the next - forever... Long after I am gone."

"It is to the greater good of the state of Arizona that the Coyotes remain here. Obviously, I am not negotiating but I have been encouraging parties – including the board members of the Goldwater Institute itself – we need to have the Coyotes stay here. If they leave, it isn’t just zero sum game. It is a very severe negative impact on the state of Arizona."

Former Arizona attorney general Grant Woods was also interviewed - here is what he said:

"Does this satisfy the gift clause? I think so. If you look at the case law, the Arizona Supreme Court recently interpreted the gift clause and I don’t even think it’s that close of a call now given this pretty significant concession of Mr. Hulsizer."

"They were very clear at the Goldwater Institute – one of their people – their litigator – printed out “this is our concern” and it was this whole parking situation and the shortfall shouldn’t fall on the tax payers. Mr Hulsizer has now stepped forward recognizing that concern – he didn’t have to do it, but he’s done it and I think that really makes this a no brainer. I think it’s significant that the Goldwater Institute has done what they have done. Good for them. They have actually protected the tax payers here. They have performed a good service. Now, we need to have them to move onto other projects. We need to close this deal and keep the Coyotes here."

City Council Meeting Update


Hi folks! Here's an update from today's City Council Meeting in Glendale...

The purpose of the meeting was to give the Glendale City Manager (Ed Beasely) the go-ahead to finalize the new Arena Management and Use Agreement (AMULA) and thus proceed with the sale of the team to Mr. Hulsizer. There is much concern about the use of taxpayer money to fund the purchase and/or run the team - which is simply not what is happening here. I'll try to explain this situation as simply as I can...

The City is selling bonds in order to acquire the 100 million dollars it will take to purchase the parking rights from the Coyotes. The original AMULA granted parking and arena management rights to the Coyotes. Currently, we are not charged for parking at any arena event. This will no longer be the case once the team is under new ownership. The City will begin collecting parking fees - this money will be used to repay the money they will spend to purchase those parking rights. Currently the cost to manage the Arena is roughly 17 million a year. If the team leaves, the city will still be on the hook for that 17 million - but will be minus their major money making tenant. 10,000 people coming to Westgate for 42 games per year is better than none. 18,000 is better... but we'll work on that part later.

Should the team flee - there will be no foot traffic to pay those fees. There will be an empty eye sore in the middle of Westgate that will THEN cost the taxpayers 17 million a year to run. Any money will be GENERATED from the Coyotes. No Coyotes, no money. THEN Goldwater should have a problem with the city. Funding coming from revenue streams created by the Coyotes and their fans = no extra cost to the residents of Glendale vs 17 million guaranteed to come out of the taxpayers pockets yearly. Do the math...

Today the City Council approved a motion allowing 10 million of the 25 million that the City gave the NHL last year as insurance to be transferred into an escrow account and used as Arena Management money - should it be needed. It is not anticipated that this money will be needed - as they will be generating money from the parking fees and the voluntary CFD. The money will remain in the escrow account accumulating interest - thus making the City MORE money. That 25 million that was given to the NHL to cover "losses" for this season? It's still there. And then some. It's been collecting interest as well. So there's proof that all parties are doing everything within their power to make this work. Go through and read the documents. What the City and Hulsizer are trying to do is actually help the taxpayers and save them from paying unnecessary costs on an empty arena for the next who knows how many years.

I apologize for the short notice - but we just received word at the game last night that there will be a Glendale City Council meeting today at 1:00pm regarding an update on the Coyotes sale to Matthew Hulsizer. The meeting is open to the public and could very well be one of the final steps in finalizing the sale of the team to Mr. Hulsizer!

We're certain those in opposition will be present so we need as many Coyotes supporters out there in Coyotes gear as possible! I know the 1:00pm start time and short notice will make it hard on people to be present, but if you are able we'd really appreciate you being there, in Coyotes gear, to show your support.
