A Coalition Member's Editorial & FAQ Regarding the Glendale Deal with Hulsizer

Happy Friday everyone!!! I have a few things to share with you this Friday morning. First of all, the Save the Coyotes Coalition will be at Jobing.com Arena tailgating prior to the game from 2-5pm - as we do every weekend home game. I'd like to invite any and all Coyotes supporters to come out as we plan to have a "brainstorming session" on what our next moves as a Coalition should be. There have been rally and protest requests, though we aren't a protest group necessarily we would like to all get together and talk about what might be the most effective ways in which to get our voices heard. We've been emailing, we've been calling, we've been voicing our opinions via social media outlets. We are still not seeing any progression or response from the Goldwater Institute. It may be time to kick it up a notch. So let's get together and talk about it! If you live out of town or otherwise are unable to come to the tailgate/planning session, be sure that you have signed up for our Coalition mailing list via our website. E-mail has proven to be the most effective and quickest way for us to get in touch with all of our members and keep everyone informed. Be sure to add coyotescoalition@yahoo.com to your safe contacts list so that our emails don't end up in your spam folder!

I'd like to share with you an editorial that was sent in to us and the Arizona Republic from a Coalition member:

I write this editorial as an Arizona taxpaying citizen; proud hockey-dad of two boys, 8 and 10; and rabid hockey fan who unconditionally supports MY Phoenix Coyotes.
During the day, I am a health care professional.  After hours, and on weekends, I am either attending Coyotes games in Glendale with my family of four (season ticket holders) or lacing up my boy’s skates at the Ice Den in Scottsdale (Coyotes Amateur Hockey Association - CAHA). Televised Coyotes games, the NHL network, roller-blade street hockey, carpet mini-hockey, and travertine hallway-hockey are all consistent motivators/rewards for nightly homework completion.  Kid’s room Coyote’s décor, trading cards and memorabilia complete this image of my family eating, sleeping, and breathing hockey... in the desert!
Therefore, I feel compelled to respond to the “Almighty Goldwater Institute” and their false claims of supposed protection of the AZ taxpayer’s interests as they relentlessly attack my team, my sport, and my community.  I must speak out, not only for my family, but for the many other hockey families that we have had the privilege of bonding with via CAHA.  After my son’s Squirt tournament, the hot topic was not about what took place on the ice last night, but how helpless and hopeless all of the kids, parents and coaches felt regarding the probable loss of our beloved Yotes. Hundreds of kids, who play youth hockey at The Den will be heart-broken if their team, and possibly their entire CAHA program, is torn from them.  Likewise, many, if not all of the CAHA teaching/coaching/support staff are completely dependent upon the Coyotes for their livelihood.
The relentless GWI assault stretches well beyond our local youth and their families. Their assertion that the current terms of sale places the Glendale taxpayer “at risk” is so near sighted as to be almost comical.  If Ms. Olsen and her band of elitist-snob media-mongers believe the bond-interest burden on Glendale taxpayers is expensive, wait until they unleash the economic catastrophe that will ensue once the Coyotes depart. Westgate, along with all restaurants and shopping venues, will be rendered unviable. Pair this with the pending NFL lockout and you have a massive loss of revenue (sales and sales-tax) for the City of Glendale.  The domino effect of this local economy in peril will certainly spread to the rest of the Valley and hundreds of millions of dollars (and hundreds of jobs) will be lost.
GWI, we the citizens know of your ulterior motives, your thirst for political gain, and understand the games you are playing.  We know of your links to the Diamondbacks (conflict of interest), your support for Winnipeg, and your underhanded backroom deals that must be taking place.  Your misinterpretation and misrepresentation of AZ law is egregious and irresponsible. I call on all of my fellow citizens to demand an investigation into GWI and its practices. When the smoke finally clears, “We the People” will prevail and justice will be served.  You, my friends, are NOT above the law and must be held accountable for your actions.
And to all of the naysayer Coyote-bashers out there that believe hockey does not belong in Phoenix, think again.  We currently have a playoff-bound group consisting of an extremely talented young core of players, outstanding veterans, and a world-class goalie… all paired with perhaps the finest coach in the NHL.  Add a strong ownership presence and you have the perfect recipe for a stable long-term hockey franchise that thrives in the Valley.  We are a cohesive, resilient team with a bright future.  Although a small voice, my family and I want to shout from the rooftops “We believe in our Phoenix Coyotes!!!!”  PLEASE lend your voices and howl in support of our team.  We are the Phoenix Coyotes.
Brent Silver, MD
--with loving support from Susan, Noah, and Evan
Scottsdale, AZ

Thank you for sharing this with us Brent - and many thanks to you and your family for your great support of the Phoenix Coyotes, the Coyotes Coalition and hockey in Arizona!!!

GLENDALE & NHL COYOTES AGREEMENT FREQUENTLY ASKED QUESTIONS
The city of Glendale is releasing an FAQ sheet to present facts about its business
agreement with Matthew Hulsizer, a potential buyer of the National Hockey League (NHL) Coyotes team. This FAQ has been designed to alleviate the misinformation created by the Goldwater Institute.
1. Does this deal violate the Arizona Constitution?
No. The Arizona Constitution case law says that public and private entities can work together on projects that benefit the community, so long as the transaction does not require that the public entities’ financial obligation is “grossly disproportionate” to the benefit received. This legal standard was clarified in the 2007 Turken v. Gordon case, which involved the City North development in North Phoenix. Although the law is clear, the Goldwater Institute has consistently misstated the legal test, saying that the assistance must be “roughly proportionate.” With respect to the city’s transaction with the new
owners of the Coyotes, four separate legal opinions concluded this agreement does not violate the Gift Clause of the Arizona Constitution. Former Arizona Attorney General Grant Woods also has publicly expressed that opinion. Nevertheless, the Goldwater Institute remains opposed to the transaction based on a clearly flawed analysis. The Institute and its small base of supporters are using baseless threats of litigation, with its associated delay and significant costs, as a means of preventing the implementation of the proper decisions of elected officials.
2. What are the consequences of the Goldwater Institute’s continued threatened legal action?
The Institute’s threats could cost the very taxpayers they claim to support millions of dollars. If this agreement doesn’t move forward, the taxpayers of Glendale will face losses of hundreds of millions of dollars, and the entire region will suffer the loss of revenues, businesses and jobs. The Institute’s goal of preventing any viable transaction that will keep the Coyotes in the Jobing.com Arena will cause irreparable harm to those they ostensibly claim to be protecting.
3. Is it true that if the Coyotes move out of state Glendale could just replace the 40 game nights with concerts and other activities, and the taxpayers, who are still paying for the Arena, will be no worse off?
No. This is a very irresponsible myth that ignores the reality of the business of running an arena facility. The economics of an arena are focused on corporate sponsorships – advertising, suites, etc. All of those factors are negatively altered without a professional sports franchise as a primary tenant. The Institute’s naïve suggestion that bringing in the “Ice Capades” would allow the city to cover the debt service on the bonds that exist today – regardless of whether or not the Coyotes remain in Arizona –  is ludicrous. Sponsors spend a lot of money to buy suites only at venues that have consistent events, concerts and professional sports. As the anchor tenant, the Coyotes fill about 1/3 of all events at the Arena, and the games have been a catalyst for all businesses in the area. In addition, because of the strength of the Coyotes as the anchor tenant, the city has been able to successfully pay its arena debt.
4. Has the Goldwater Institute provided the city with any input on the deal or suggested how the deal should be structured to avoid legal action?  The Goldwater Institute should never be allowed to use its extreme political philosophy to dictate how a public entity conducts business. The city is very capable of understanding and properly implementing the law. That said, the Goldwater Institute refuses to meet with the city of Glendale, the NHL Commissioner or even potential owner Mr. Hulsizer so that the Institute could be educated on this transaction and conduct a proper analysis. The last discussion the city had with the Goldwater Institute was on January 17, 2011, in which the city and Mr. Hulsizer discussed why the agreement did not violate the Gift Clause. The Institute said they were still completing legal analysis and did not have any specific comments regarding the structure of the deal but would provide an answer regarding possible litigation by the end of that week. The Institute indicated very clearly that they would not merely provide a “non-answer.” Yet, at the end of that week, on Friday at 4:45 p.m., the Institute issued a press release indicating more research and more time was needed.
The city inquired if the Institute needed any more documents or had more questions and the Institute expressly stated that nothing else was needed during their “internal review.” Throughout the next two months, the NHL, Glendale and Mr. Hulsizer, along with community and business leaders, U.S. Senator John McCain and former Arizona Attorney General Grant Woods, have actively encouraged the Institute to meet with the city’s attorneys and provide specific feedback on any legal issues. These attempts have been met with no return phone calls or emails and the only way any of the parties have received information from the Institute has been through often-issued, late-afternoon press releases. In most situations where parties are dealing in good faith to achieve a positive end result, the parties try to meet, discuss, clear up misconceptions and come to a resolution.
5. Does the Goldwater Institute want the Coyotes to leave Arizona? According to an “Arizona Republic” article on March 17, 2011, the Goldwater Institute’s litigation director is a member of a Facebook group called “Support the Goldwater Institute Bring Home the Jets.” This is a website with the expressed goal of bringing the Coyotes back to Canada. This action reflects complete impartiality some members of the Institute may have in evaluating the agreement.
6. If the Coyotes leave Arizona, will the Goldwater Institute be to blame?
Absolutely. The Institute’s baseless threat of litigation is preventing this publicly beneficial transaction from being concluded. The Goldwater Institute inappropriately sent letters to bond-rating agencies and the city’s bank trustees misrepresenting the law and asserting that the Institute was “thinking” about a legal challenge against the city. Those tactics put the entire process at risk. The Institute’s actions created a threat to potential bond buyers thus creating higher interest rates and challenges in selling the bonds overall. The NHL Commissioner said publicly on March 9, 2011, that Goldwater’s tactics impacted the bond underwriters and he questioned “…whether this is really an organization that is concerned with the public interest despite a mission statement that calls for expanding free enterprise and support for the public interest.”
7. Did the city of Glendale allow citizens, and specifically the Goldwater Institute, to speak publicly about the most recent agreement to purchase the Coyotes?
Absolutely. Since the team was unexpectedly placed in bankruptcy, there have been several public meetings about possible business agreements between the city and potential owners. In regards to this most recent agreement with Mr. Hulsizer, hundreds of citizens attended public meetings providing input. Not once did the Goldwater Institute participate in one of Glendale’s public meetings. Furthermore, thousands of pages of public documents have been provided to the Goldwater Institute.
8. What is Glendale’s agreement with the new buyer of the Coyotes, Matthew Hulsizer?
Over the last 2 ½ years, the NHL and the city of Glendale have been focused on selling the team to an operator who will make it a very successful franchise and will commit to keeping the team in Glendale for at least the next 30 years. In December 2010, the Glendale City Council approved an agreement with Matthew Hulsizer. Major agreement points:
a. Mr. Hulsizer has the option to purchase the city-owned Jobing.com Arena during the term of the agreement and the city has an option to sell the Arena to the team entities at the end of the agreement—both options provide substantial benefit for taxpayers.
b. The agreement contains a profit-sharing component that is unique in North American sports, in which the city will share in team and Arena revenue over the life of the deal.
c.  The city will purchase the right to receive all income generated by parking rights at the Arena, including all profits generated from naming rights, signage and parking fees.
9. Why is it a big deal for the city to purchase the parking rights?
The Hulsizer group will own the parking rights to the Arena, just as would any other entity that leases a facility. But now with this agreement, Glendale will be able to create new revenue for the city by assuming these rights. The city can charge for parking year-round at every event at the Arena generating millions of dollars over the term of the agreement.
The parking studies completed by highly professional, independent consultants during the negotiating process determined the amount of money that could be generated by purchasing the parking rights and that the city is paying a fair amount for these rights.
10. How can I keep up-to-date on the city’s progress with finalizing the purchase agreement and also show support?
In an effort to continue to be transparent throughout this process, the city of Glendale regularly updates the Coyotes situation on the front page of the city website at www.glendaleaz.com. Throughout this entire process, the city has posted hundreds of pages of documents related to the Coyotes agreements online so citizens could remain involved and informed. The documents are all available online through the city’s archive system. Many residents have demonstrated support for Glendale’s efforts to keep the Coyotes by contacting their local elected officials, the Coyotes fan clubs, the Coyotes team, the NHL and the media through letters, emails, phone calls and social media.

Now folks, I hope you all have a great weekend and I'll see you at Jobing.com Arena as our Coyotes take on the San Jose Sharks Saturday night!

Radio Show!

There were a few developments of note this week in the sale of the Coyotes to Matthew Hulsizer.

We'll start with the good news: Glendale residents finally spoke out in support of their Mayor and her efforts to get the Coyotes deal done. One Glendale resident said: “We trust the mayor, the council and city staff in every other aspect of the operation of Glendale, and we should trust them here,” said Gail Meyers. “It would be a giant step backward for Glendale if this deal doesn’t go through." Mayor Scruggs also announced to those in attendance at the meeting that the bonds were on the market and we're just waiting for them to sell. The deal is expected to close soon.

The bad news: The Goldwater Institute has officially announced their intent to file suit once the deal is completed.

Radio Show: Coyotes Coaliton Vice President Monique Reaux and myself are going to be in the studio today for the Breakthrough Sports radio show on KXXT 1010 AM. We've got a great show planned so I hope you'll all be able to tune in from 2-4 (AZ time) this afternooon. We'll be dissecting the Darcy Olsen interview from last week's show and giving our thoughts on it. Rebekah Sanders of the Arizona Republic will be calling in during the first hour. Rebekah has been covering the Coyotes situation since the team was first put into bankruptcy by the previous owner in 2009.

At 3:00pm we'll be speaking with NHL Deputy Commissioner Bill Daly and getting his thoughts on the situation. We will also be hearing from Coyotes Vice President of Marketing & Communications - Jim Brewer - who will be calling in to discuss the actual hockey and the team's success as of late.

The hosts are working to get some legal minds lined up as call-in guests today as well to help us dissect the Gift Clause and attempt to determine what we are up against if Goldwater files suit.

It will definitely be a show you don't want to miss!

Greg & Dave Isaac, who host the show - welcome Coyotes supporters to come down to the studio if you would like. You are also welcome to call in with questions or comments as well.

Odds of GWI Backing Off

When it comes to fiscal responsibility, you will never hear anyone defending the need for sound economic measures and private employment as loudly as a conservative. Not to get overtly political this early in the morning, but those situated on the right have historically championed community-based business and have sternly promoted the vivacity of entrepreneurship.

Why, then, does the Goldwater Institute (GWI) seem absolutely intent on shipping the Coyotes out of Phoenix? It doesn’t make much sense; it certainly goes against the grain of fiscal conservatism to push for a jobs machine to leave.

The saga is thick and seemingly never-ending, but the gist of it is that GWI is upping the pressure in threats to sue the city of Glendale if Mayor Elaine Scruggs goes through with the bond sales to assist a Chicago businessman who would essentially buy the team and leave the Coyotes playing in Glendale for the next thirty years.
If the Coyotes leave and the NHL throws them back up over our northern border, the city is looking at a reported financial loss of over $500 million. Five-hundred-million. $500,000,000!

That’s scenario one. Scenario two: GWI’s tampering with the sale of the bonds has caused them to almost double in price, making the charge around $200,000,000 to the taxpayers if they insist on being insistent.
Regardless of how things turn out, this supposedly fiscally-sound taxpayer watchdog organization has cost the taxpayers at least $100 million; and if they continue to do what they’re doing and bust the sale, they’re costing exponentially more.

With friends like this, who the heck needs enemies?

Some claim that GWI is only bluffing and will not sue the city for the “Gifts Clause” transgression. But if that were the case, which many are hoping it is, of course, GWI would have simmered down a tad by now. They have not – they’re pressing forward with gusto.

Practically speaking, what are the odds of the Goldwater Institute actually getting out of the way and allowing the city to save their hockey franchise and thus keep some semblance of economic standing?
Well, we’re not talking about basic odds here. This isn’t sports-betting and the sure the heck isn’t online casino games. The implications are real and real damaging for residents of the area who rely on and love this franchise.

In fact, the need and love the city has for its franchise is the factor boding the best for the Coyotes. With the overwhelming support being showed, rumors are that top advisors are suggesting GWI back down and to stop pressing so hard for the sale to fall through.

Another factor boding well for ‘Yotes fans is that Arizona is already a hotbed of national controversy, with the “right” bearing a lot of the brunt for its difficulties. GWI really doesn’t need this to break nationally and have its efforts backfire as an attempt to stifle economic growth.

To put a guess on it, which unfortunately is all anyone can do, the odds suggest that GWI really is bluffing and should relent in its pressures in the coming weeks to ultimately allow the sale to happen.

Since we’re all about gambling, though, we’ll put a number on it. We’ll say that it’s 2:1—even money—that GWI backs off and shows its cards. And if the top US online casinos and sports books kept these kinds of numbers, you would be able to make a pretty penny in the process.

The odds are still pretty good that GWI will eventually sue. The institute seems to have some type of perverted need to stay relevant in a dwindling market which would forget about its existence if not for situations like these. So after the sale goes through—assuming, of course—and the waters die down, don’t be surprised to hear breaking news about GWI pushing to sue the city in a political move that will promote one of its preferred candidates over the non-partisan Scruggs when the cycle comes back around.

The best news is that the NHL is basically indifferent at this point. They’re exhausted from exhausting and would rather the sale be finalized to get things over with so they can prepare for the hot-push of media for the Stanley Cup Playoffs as an organization.

Eventually, we have a good feeling that Coyotes fans and the citizens of the area will be pleased with the outcome. It’s a shame the fight has carried on this long, but sanity should prevail and Glendale should be able to keep pace competitively in the economy.

Now We Get Down And Dirty (as if it weren't bad enough already...)

Update: 3/07/2011 10:00am

--------------------------------------------------------------------------------------------------------------

On Friday ESPN reported that the City of Glendale had plans to file suit against the Goldwater Institute today.

ROCK ON GLENDALE!!! I certainly hope those "reports" are true.

Not only are they expected to file suit against the Institute itself - but specific members of their board as well. Namely Randy Kendrick - wife of Arizona Diamondbacks owner Ken Kendrick. Whose husband stands to lose the most should the Coyotes stay and prosper - supposedly.

Do I really believe she's trying to sabotage the sale? Not really. I don't think that the Coyotes have that much of an impact on the Diamondbacks attendance to make her want to do something so vindictive. We only play a few games a year at the same time the baseball team does - and our attendance typically sucks at the beginning of the season anyway. Could it be the competition for sponsorship deals? Maybe... but I'm not really feeling it.

I think there's someone else involved, not necessarily on the Goldwater board but perhaps financing their shady endeavors. Money talks, right?

It is evident that the Goldwater Institute has spent considerable time, effort - and someone's donated money in order to stall the sale of the Coyotes to Matthew Hulsizer. They are a private company and thus can keep their investors private. But I'd sure like to know who has been donating lately...

According to ESPN's report, the Goldwater Institute has contacted potential bond investors and warned them to stay away from the deal - threatening to file suit should the sale go through. What does that tell investors? You're buying "junk bonds". That's a lot of unnecessary effort, time and money spent on ruining a transaction that hasn't even occurred yet.

Goldwater says Glendale "withheld documents". Yet Mayor Scruggs was informed back in December that they had all the information they needed. Mayor Scruggs has also asked repeatedly to have a sit down with the Goldwater board - face to face - to explain the transaction and answer any questions they may have. They have repeatedly refused. If they were looking out for the interests of the taxpayers - as they claim - wouldn't they at least be willing to sit down and discuss this with the Mayor?

There is much debate regarding the parking rights and who actually owns them. Goldwater insists that the City still owns the parking rights and that they would essentially be purchasing nothing then. However, according to the lease that the City had in place with the old team owner (who's name shall no longer be found in my posts) - the team controlled the parking rights and added on a surcharge to our ticket prices - then paid the city from that.

A new lease agreement was entered into with the NHL when they purchased the team. I don't recall what all that lease arrangement entailed however... The NHL and the City - to my understanding - did not make huge changes to the lease agreement that was in place prior to the NHL's purchase of the team. The team is still - at this point - not charging people for parking. So one can reasonably assume that those parking surcharges are still being applied to our ticket prices and the NHL is paying the City as agreed in the prior lease agreement.

So... does this mean that the NHL actually owns the parking rights? Well in that case - Goldwater REALLY doesn't have a leg to stand on in a law suit. Never mind the trouble they are causing with their shady business practices along with the billions of dollars they are trying to rob Glendale residents of in unnecessary tax increases should the team leave - now they are also tampering and quite visibly trying to destroy a private business deal. Which is illegal, dear Goldwater - as you should know. The City is simply purchasing back their parking rights. Nothing illegal about that...

Coalition Update

I've received several emails and tweets from Coalition members asking what can be done at this point in the Coyotes ownership situation to help the sale of the team to Mr. Hulsizer reach completion.

As you've likely heard or seen - Mr. Hulsizer was on the Fox Sports Arizona Coyotes broadcast from Chicago last Saturday night discussing the ownership situation. (You can watch the video here.) Mr. Hulsizer stated that he is ready to close the deal but the threat of suit by the Goldwater Institute is causing the interest rates on the bonds the city is trying to sell to sky rocket - thus causing Glendale to face millions of dollars in excess interest rates to be paid once the bonds are sold.

It's hard to tell what's true and what's false in this case not being privy to important information about the negotiations and stances of those involved - but I think its safe to say that Goldwater is slowing the process quite a bit - without a good basis for it.

When reading the front page of their site regarding the Coyotes deal - they state that there have been some media reports indicating that "the city of Glendale intends to offer some form of taxpayer subsidy to a new owner of the Phoenix Coyotes as an incentive to keep the hockey team in Glendale. This is a potential violation of the Gift Clause."

The deal that Glendale has put together with Mr. Hulsizer is NOT in violation of the Gift Clause and what Goldwater is doing to stall the sale is costing the taxpayers additional money in legal fees and this could cause the interest rates they would have to pay once the bonds are sold to be unreasonably high. This will do far more damage to the city and the taxpayers in the long run. Not to mention the empty arena that would be left behind if the team moved. It's simply unacceptable.

So what do we - as taxpayers and supporters of the Coyotes - want Goldwater to do? Back off - let the deal progress. Let the Coyotes go to the playoffs with their new owner in tact. Let the Coyotes fans renew their season tickets with confidence and watch the team flourish under good ownership. If and when a real law is broken, then Goldwater can sue - but it will not likely be necessary.

I'm certain that Goldwater has been receiving much feedback in support of their case against the City - seeing as there are so many who seem to want to relish in the demise of hockey in Arizona. Most of which is likely coming from non-Arizona residents to be quite honest - probably not even residents of the United States at all. There are also obviously some heavy-pocketed investors funding their little foray. It's time that Goldwater got some feedback from those of us who oppose their position on the Coyotes deal.

If you are an Arizona resident - I ask that you please take some time out of your day to email the Goldwater Institute and voice your support for the deal that the City of Glendale has arranged with Mr. Hulsizer. If you could forward this to our fellow Coyotes supporters and ask them for their help, it would be much appreciated. The more the better.

If you are not a resident of Arizona but have some feedback you'd like to share with them in support of the deal - please send in your thoughts in as well. Resident's of Glendale - they REALLY need to hear from you!

If you'd like to read up on the situation in preparation for your emails, there's lots of good information out there:

Arm yourselves with knowledge and hit 'em hard - but courteously.

The general contact email for Goldwater is: info@goldwaterinstitute.com. Tell them you're with the Coyotes Coalition and you want them to hear our side and protect our rights.

Here's some additional contact emails I've been able to locate that are or may be important people regarding the Goldwater vs City of Glendale case:

*Clint Bolick - Director of Goldwater's Scharf-Norton Center for Constitutional Litigation (they are handling the case) - cbolick@goldwaterinstitute.org

*Carrie Ann Sitren - Staff Attorney for the Goldwater vs City of Glendale case - csitren@goldwaterinstitute.org

*Darcy Olsen - President and CEO of the Goldwater Institute - dolsen@goldwaterinstitute.org

Kara Caldwell - Executive Assistant to the President of Goldwater Institute - kcaldwell@goldwaterinstitute.org

Nick Dranias - Goldwater Institute's Director of their Center For Constitutional Government - ndranias@goldwaterinstitute.org

Mark Flatten - Goldwater Institute Investigative Reporter - mflatte@goldwaterinstitute.org

Matthew Ladner - Goldwater's Vice President of Research - mladner@goldwaterinstitute.org

If you want to cc me your email to them, feel free to do so. Be sure to cc coyotescoalition@yahoo.com and I'll keep a record of them all so that we have them if we need them.

Also - Glendale Mayor Elaine Scruggs held a press conference today - in which she addressed the economic atrocities that the Goldwater Institute would impose upon the taxpayers they claim to protect by blocking the sale of the Coyotes to Mr. Hulsizer. Literally billions of dollars in legal fees and then no team to keep the arena and Westgate afloat because the sale could not go through. It would be economic suicide for the city and their residents should the sale not go through. I personally highly doubt that the NHL would be willing to keep the team here for another season if the Hulsizer deal were to fall through now. The NHL has been very, very patient and they've been wonderful to the fans here - but they have the interests of an entire league and 29 other owners to keep in mind as well. It's now or never - and you can hear the urgency in Mayor Scruggs' voice. Have a listen - it's eye opening stuff. The Goldwater Institute has tried it's hardest to put the city in a negative light throughout this process, but they are the ones who are actually engaging in shady practices to obtain their goals. Here's the podcast of the Mayor's remarks from the Coyotes website.

One last note: I will be on Breakthrough Sports tomorrow afternoon on KXXT 1010 AM around 3:40 pm with Dave Isaac discussing the Coyotes situation. The show is very Coyotes oriented and Dave is a great Coyotes fan and a member of the Coalition. The show is on every Friday from 2-4pm. I'd love for you to tune in, call in and share your thoughts, ideas and support!

If you have any questions, feel free to shoot me an email anytime. I'll get back to you as soon as possible!

If you are a Coyotes supporter and haven't joined the Coalition yet, what are you waiting for? Go to our website at www.coyotescoalition.com - enter the requested information and viola!

City Council Meeting Update

Hi folks! Here's an update from today's City Council Meeting in Glendale...

The purpose of the meeting was to give the Glendale City Manager (Ed Beasely) the go-ahead to finalize the new Arena Management and Use Agreement (AMULA) and thus proceed with the sale of the team to Mr. Hulsizer. There is much concern about the use of taxpayer money to fund the purchase and/or run the team - which is simply not what is happening here. I'll try to explain this situation as simply as I can...

The City is selling bonds in order to acquire the 100 million dollars it will take to purchase the parking rights from the Coyotes. The original AMULA granted parking and arena management rights to the Coyotes. Currently, we are not charged for parking at any arena event. This will no longer be the case once the team is under new ownership. The City will begin collecting parking fees - this money will be used to repay the money they will spend to purchase those parking rights. Currently the cost to manage the Arena is roughly 17 million a year. If the team leaves, the city will still be on the hook for that 17 million - but will be minus their major money making tenant. 10,000 people coming to Westgate for 42 games per year is better than none. 18,000 is better... but we'll work on that part later.

Should the team flee - there will be no foot traffic to pay those fees. There will be an empty eye sore in the middle of Westgate that will THEN cost the taxpayers 17 million a year to run. Any money will be GENERATED from the Coyotes. No Coyotes, no money. THEN Goldwater should have a problem with the city. Funding coming from revenue streams created by the Coyotes and their fans = no extra cost to the residents of Glendale vs 17 million guaranteed to come out of the taxpayers pockets yearly. Do the math...

Today the City Council approved a motion allowing 10 million of the 25 million that the City gave the NHL last year as insurance to be transferred into an escrow account and used as Arena Management money - should it be needed. It is not anticipated that this money will be needed - as they will be generating money from the parking fees and the voluntary CFD. The money will remain in the escrow account accumulating interest - thus making the City MORE money. That 25 million that was given to the NHL to cover "losses" for this season? It's still there. And then some. It's been collecting interest as well. So there's proof that all parties are doing everything within their power to make this work. Go through and read the documents. What the City and Hulsizer are trying to do is actually help the taxpayers and save them from paying unnecessary costs on an empty arena for the next who knows how many years.

Sorry for the Short Notice! City Council Meeting Today!

Hi all!

I apologize for the short notice - but we just received word at the game last night that there will be a Glendale City Council meeting today at 1:00pm regarding an update on the Coyotes sale to Matthew Hulsizer. The meeting is open to the public and could very well be one of the final steps in finalizing the sale of the team to Mr. Hulsizer!

We're certain those in opposition will be present so we need as many Coyotes supporters out there in Coyotes gear as possible! I know the 1:00pm start time and short notice will make it hard on people to be present, but if you are able we'd really appreciate you being there, in Coyotes gear, to show your support. Here's more information on the meeting:

Where: Glendale City Council Chambers
5850 W. Glendale Ave.
Glendale, AZ 85301
When: 1:00pm Tuesday February 15, 2010

The meeting will begin promptly at 1:00pm so please be on time. I will be there in my Kyle Turris jersey - so please stop and say hello if you spot me. I know this is short notice - but it would be great to see as many people as possible there! I know the team would appreciate our support, as always!

Could the Saga of the Coyotes Ownership be Coming to an End???

As I woke up this morning, rubbing the sleep from my eyes - I happened to log into my Twitter account and see a tweet from my good friend Travis over at Five For Howling stating that the city of Glendale was scheduled to sell it's illusive bonds that everyone has been so up in arms about recently. So I thought I'd check it out...

According to Moody's  the City of Glendale has issued bonds to be sold this coming Tuesday. Moody's is a financial research company that gives governments and companies credit ratings - and they also rate bond sales. The sale is structured as two different bond issues - one for 107 million dollars and rated as an A1 - the other for 9 million - it is also rated as an A1. To learn all about what that means you can follow this link to see the information. Registration is required to view the document.

What an "A1" rating means in simple terms is that the rating is slightly greater that a "quality" rating. The rating structure starts at "AAA" being the highest quality and goes down to a "D" meaning that the credit rating indicates default. This is not a bad credit rating for the city - even with the recent economy - they remain at "Quality" status. It shows that the city has credit stability but that there is still some risk involved in their ability to repay their debt should the economy not improve.

It is stated in the Moody report that the bonds are being sold to purchase parking rights at Jobing.com Arena from the Coyotes. For those of you who have been following this issue closely - you also know that the money they will get from selling those bonds will be given to Matthew Hulsizer and used to purchase the team. So... I don't want to jump the gun on this one but... could this ownership situation finally becoming to a positive end for us? Stay tuned.... That certainly would make a wonderful Valentine's Day present!
